Construction Lien Law

Construction lien perfection, prosecution and defense are a big part of Becker & Poliakoff's construction practice. The Construction Lien Law established the ground rules for enforcing a construction lien on real property however, it continues to create confusion among industry professionals. Firm attorneys work closely with clients in the construction industry to understand the operation and enforcement of the Construction Lien Law and the importance of timely attention to notices received from contractors, suppliers and others furnishing labor or materials or that provide certain professional services to real property. We work with clients regarding procedures for proper payment to contractors; the responsibilities to subcontractors and suppliers; the impact of payment and performance bonds; the consequence of contractor liens. Lee Weintraub, vice-chair of the Firm's Construction Group, has taught the Florida Construction Lien Law to lawyers studying to take the Florida Bar's Construction Board Certification Exam every year the Certification Review Course has been offered.  He has taught the Lien Law to contractors large and small and to owners of construction projects including in-house construction teams at a major Orlando theme park.
